1. Introduction & Acceptance of Terms

Welcome to MeroSwar ("the Service"), an augmentative and alternative communication (AAC) platform engineered and operated by Jyotir Health Pvt. Ltd. ("we", "us", or "our"). By accessing or using the MeroSwar website, Progressive Web App (PWA), or associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please discontinue use of the platform.

2. Assistive Communication Scope & Purpose

MeroSwar is an assistive augmentative communication software tool created to facilitate picture-based language generation and expression for non-speaking or speech-delayed individuals, their families, educators, and speech-language pathologists (SLPs).

Assistive Nature of the Service: MeroSwar is an interactive communication aid and educational utility. It does not provide medical diagnoses, clinical prescriptions, or formal medical treatments. Any communication decisions, therapy progressions, or dietary adjustments made with or through the app remain the responsibility of the caregiver, parent, or supervising healthcare professional.

3. Device Licensing & Offline Availability

MeroSwar is designed as an offline-first Progressive Web Application. When installed, communication cards, audio synthesizers, and sentence boards operate locally on your device hardware without requiring an active internet connection.

• Core License: Licensed users receive full offline access to foundational clinical core communication cards and active categories for speech expression and language development.
• Caregiver Pro / Expanded Tier: Subscribed caregivers receive single-device cloud lease privileges, enabling multi-device cloud backup, custom voice phrase recordings, personalized family photo uploads, and custom card management.

4. Intellectual Property & Symbol Attribution

The software architecture, user interface designs, custom Nepali linguistic sentence trees, and brand trademarks (including "म MeroSwar") are the intellectual property of Jyotir Health Pvt. Ltd.

Open-Source Symbols Attribution: MeroSwar incorporates pictographic symbols from ARASAAC (Aragonese Center of Augmentative and Alternative Communication, Government of Aragon), licensed under the Creative Commons License (BY-NC-SA 4.0). Users and caregivers may not extract or commercially re-sell standalone ARASAAC pictograms outside the permitted CC license terms.

5. Caregiver Content & Custom Cards

Any customized photos, audio recordings, or vocabulary cards created on your device remain entirely your property. You represent that any photos or recordings you upload do not infringe upon any third-party intellectual property or privacy rights.

6. Limitation of Liability

To the maximum extent permitted by applicable law in Nepal and internationally, MeroSwar and Jyotir Health Pvt. Ltd. shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the platform, including any hardware failure or data synchronization delays.

7. Modifications to the Terms

We reserve the right to amend these terms as our software evolves. Material revisions will be posted directly to this page with an updated effective date. Continued use of MeroSwar after changes are posted constitutes your acceptance of the revised terms.
